Ballot Tabulator provides electronic voting and election management software for homeowners associations (HOAs), condominium associations, and similar community organizations. The Service includes features for voter registration, ballot creation, digital sign-in, proxy management, vote tabulation, and report generation.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring all information you provide is accurate and current

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Impersonate any person or entity
  • Use the Service to conduct fraudulent elections

5. Election Integrity

You are responsible for ensuring that your use of the Service complies with your association's governing documents, bylaws, and applicable state and local laws regarding elections and voting procedures. Ballot Tabulator provides tools to facilitate elections but does not guarantee compliance with specific legal requirements.

6. Data Ownership

You retain ownership of all data you input into the Service, including voter information, ballot configurations, and election results. You grant us a limited license to use this data solely to provide the Service to you.

7. Fees and Payment

Certain features of the Service may require payment. You agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable unless otherwise stated.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALLOT TABULATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Ballot Tabulator and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms
